Terms and Conditions for Purchasing and Booking Tickets

1. General

1.1 Each ticket that you purchase from movies@ Montecasino is subject to these Terms and Conditions as well as any additional terms and rules applicable to the particular movie and/or event (“the Ticket Terms”). Such Ticket Terms may be referred to or set out on the relevant ticket or may be made available elsewhere on this web site or the movies@ Montecasino cinema.

1.2 Any use of the services provided for on this Web Site including, but not limited to, the purchase of tickets is at the purchaser’s risk. The purchaser / user indemnifies and holds Proprietary Limited t/a movies@ Montecasino (“movies@ Montecasino”) harmless against any loss, injury or damages which may be sustained as a result of using the service or the ticket sold on this Web Site.

1.3 Movies@ Montecasino may cancel forthwith any ticket(s) purchased through this Web Site in the event that the purchaser breaches any of its obligations hereunder and may refuse to accept any future bookings from the purchaser / user. This shall be without prejudice to any rights or remedies movies@ Montecasino may have in law.

1.4 Booking or Purchase of Tickets

1.4.1 Tickets may be booked:

1.4.1.1 via this website by completing the online booking form, and submitting your payment details as stipulated;

1.4.1.2 via the onsite ticket counter on 011-511-0244. A booking fee is applicable for all tickets booked through the onsite ticket counter.

1.4.1.3 Alternatively, directly at movies@ Montecasino cinemas.

1.4.2 It is the purchaser’s obligation to ensure that all the information contained in the online booking form is correct and all payment information is correct. If booking information is incorrect, movies@ Montecasino is not obliged to rectify any errors.

1.4.3 Once submitted, a booking request will constitute an offer on the terms and conditions contained herein together with any Ticket Terms. Such offer is open for acceptance by movies@ Montecasino and/or the Event Organisers to conclude a binding agreement with you. It is your responsibility to review these terms and conditions as well as any Ticket Terms before making a booking. Movies@ Montecasino reserves the right not to accept or process your booking request and movies@ Montecasino will notify you if this is the case.

1.4.4 Following receipt of your booking request, movies@ Montecasino will send you a confirmation notice confirming acceptance or rejection of your booking request containing the relevant booking number. Please note that whilst every effort is made to send you a confirmation notice for every valid booking request movies@ Montecasino receives from you, movies@ Montecasino cannot guarantee that such confirmation notice will be received by you, nor that, if same is received by you, that they will be legible and uncorrupted. Your failure to receive such confirmation notice will not affect the validity of the agreement concluded between us or the Event Organisers in respect of a booking.

1.4.5 It is your duty to confirm with the movies@ Montecasino onsite ticket counter whether or not your order has been received and processed if you do not receive a confirmation notice after submitting your payment information, or if you experience an error message or service interruption after submitting your payment information. Movies@ Montecasino will not be liable for any losses you may incur if you assume that a booking was not processed because you failed to receive our confirmation notice.

1.4.6 The information you have submitted with your booking request will be processed as you have provided it. If you realise that an error has been made or that you need to make a change to such information, you should immediately contact the movies@ Montecasino onsite ticket counter.

1.4.7 If you are not yet 18, you must obtain your parents’ or legal guardians’ advance authorisation, permission and consent to be bound by our terms of use prior to you using any of our services or participating in any of the activities offered. The use of some of our services may require that you are over 18 and of full legal capacity. In such event you should ask your parent or legal guardian to perform the transaction for you.

1.5 Pricing of Tickets and Information about Movies and/or Events

1.5.1 The details of the movies and/or events (including the venues and seating arrangements) for which tickets are offered are contained on the Web Site and other media. The supply of tickets offered depends upon the availability thereof. Unless otherwise stated, all prices displayed are in South African Rand. Movies@ Montecasino may without prior notice change the price, discontinue the availability or change the description of venues, seating arrangements or events for which tickets are made available. Special promotions and/or events may be subject to certain additional terms and conditions.

1.5.2 Although every effort is made to ensure that the venues, seating arrangements and events are displayed and described completely and accurately, movies@ Montecasino does not warrant same and disclaim, to the maximum extent permitted by law, any liability arising from any omissions and inaccuracies pertaining to such display and description. In particular, movies@ Montecasino disclaim any and all warranties as to the occurrence, suitability or quality of the seating arrangements, performances, venues or events and will not be liable for any claims arising in respect thereof, even if movies@ Montecasino has acted in a negligent manner.

1.5.3 All prices indicated with regard to tickets will be exclusive of delivery fees which will be separately charged to you in respect of all deliveries in accordance with the specified rates.

1.5.4 All prices indicated with regard to tickets on this Web Site will be inclusive of VAT but exclusive of any other taxes and duties, which, unless otherwise indicated, will be charged separately.

1.5.5 In the event of a cancellation, exchange, refund or replacement of tickets a stipulated administration fee may also apply.

1.6 Payment

1.6.1 You will be required to provide the necessary payment details (such as credit card details) and to authorise payment of the amounts payable for the tickets ordered when submitting your booking request. Such authorisation will allow movies@ Montecasino to obtain payment at any time after confirmation of your booking.

1.6.2 If movies@ Montecasino is unable to duly effect such payment for any reason your booking may be cancelled and your tickets may be resold to another customer without further notice.

1.6.3 If the price you paid for a ticket is incorrect for whatever reason, movies@Montecasino will have the right to cancel that ticket (or the order for that ticket) and refund to you the full amount that you paid in respect of the ticket. Movies@ Montecasino may similarly cancel any ticket that you were sold that movies@ Montecasino was not entitled to sell at the time you purchased and refund to you the full amount that you paid in respect of the ticket.

1.7 Refunds, cancellations or exchanges

1.7.1 Please note that generally no exchanges of tickets purchased are possible, including in respect of bookings being incorrectly processed because of an error. Any refund, cancellation or exchange made may be subject to a fee to be determined at the discretion of movies@Montecasino. However, movies@ Montecasino is legislatively bound to give full refunds in cases of hospitalisation or death, and movies@ Montecasino shall require proof thereof.

1.8 Collection of Tickets

1.8.1 Tickets purchased online or via the onsite ticket counter can be collected at anymovies@ Montecasino Self Service Terminal or onsite ticket counter. The credit card with which the ticket was purchased will need to be swiped in order for the ticket to be printed.

1.9 Age and Age Restriction

1.9.1 It is your responsibility to be aware of and to adhere to age restrictions that are applied to films and/or events.

1.9.2 If a person having a valid ticket does not meet the age restriction requirements attached to the film or event, he/she will not be allowed access to the cinema or the event venue and no ticket refunds or readmission tickets will be granted.

1.9.3 When submitting a booking request you warrant and represent that you are over the age of 18 (eighteen) and that you are authorised to make payment in the stipulated manner.

1.10 Stolen, Lost or Destroyed Tickets

1.10.1 Upon receipt of the tickets all risk for loss and damage to the tickets shall pass to you. Tickets that have been stolen, lost or destroyed will not be refunded or replaced for any reason whatsoever.

1.11 Cancelled and Rescheduled Films and Events

1.11.1 Occasionally, Films and/or events may be cancelled or rescheduled by movies@Montecasino and/or the Event Organiser. In such case, movies@ Montecasino and/or the Event Organiser may offer a refund or exchange of tickets for which you may be required to follow certain procedures specified. Should this occur, movies@ Montecasino will usually provide a notice on this Web Site or contact you to inform you of the relevant refund or exchange procedures for that Film and/or event. You may also contact our ticket counter for instructions.

1.11.2 Any refund issued will be on the ticket's face value paid (or, if a discounted ticket, then the discounted ticket price paid). No other fees or charges will be refunded. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. If a credit card was used to make the purchase, then only that actual credit card will receive the credit for the refund. Movies@ Montecasino will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled or postponed event.

1.12 Right of Admission

1.12.1 Movies@ Montecasino and/or the Event Organisers reserve all rights in terms of admission to cinemas or event venues.

1.13 Security

1.13.1 Movies@ Montecasino will endeavour to ensure that necessary safety measures are in place to protect the sensitive payment information (such as your credit card details) which you provide to movies@ Montecasino.

1.13.2 Movies@ Montecasino, however, does not guarantee the absolute security of any information you transmit to it or that is transmitted to you and disclaims any liability arising in connection with any unauthorised disclosure of such information.

1.14 Warranties

1.14.1 Unless the contrary is stipulated in writing, all tickets are provided without warranty of any kind. Without limiting the aforesaid, movies@ Montecasino and the Event Organisers do not give any warranties or make any representations regarding the occurrence, timing, suitability, quality or performance of any film or event to which your ticket(s) may relate, or in respect of the venue, admission to such venue or the seating arrangements for such venue.

1.14.2 By purchasing a ticket from movies@ Montecasino, you agree to these Terms of Use on behalf of yourself and any person accompanying you. You assume all risks incidental to the film or event for which a ticket is issued, whether before, during or after show or performance. You agree that movies@ Montecasino will not be liable for any loss or damage you or anyone accompanying you may incur in the course of attending a film or an event for which you purchased tickets from movies@ Montecasino and that you will indemnify movies@ Montecasino against any claims arising in connection therewith.

1.14.3 In no event will movies@ Montecasino’s aggregate liability for all claims in connection with any transaction exceed the total amount of fees received from you pursuant to such transaction, irrespective of the cause of action (whether in contract, statute or delict, including for negligence), save to the extent that such liability cannot be excluded by law.

1.15 These Terms of Use shall override any contrary terms or conditions incorporated by you in your order and any such conflicting terms or conditions will not form part of any agreement concluded between us in respect of the goods and/or services ordered.

1.16 If any problems arise in respect of your ticket please contact our onsite ticket counter.

2. Booking Tickets offered by Movies@ Montecasino

2.1 Cinema Tickets

2.1.1 Each ticket purchased from movies@ Montecasino is intended to be a revocable license to attend the movie and/or event at the stipulated cinema at the designated time to which the ticket pertains only and will not enable you to attend any other movie and/or event.

2.2 Other Event tickets

2.2.1 Each ticket purchased from movies@ Montecasino is intended to be a revocable license to attend the event to which the ticket pertains only and will not enable you to attend any other event.

3. Booking Tickets offered by Third Parties

3.1 Each ticket purchased from movies@ Montecasino is intended to be a revocable license to attend the event to which the ticket pertains only and will not enable you to attend any other event.

3.2 Movies@ Montecasino merely acts as an agent for the providers, promoters and organisers of events (“Event Organisers”). Movies@ Montecasino sells tickets to you and collects payment from you on behalf of such Event Organisers. You are buying each ticket from the relevant Event Organiser and not from movies@ Montecasino. You are therefore contracting with the Event Organiser and your rights and obligations under the Ticket Terms are enforceable against and by such Event Organiser only. These Terms and Conditions are however, enforceable against you and by you. Event Organisers may refuse admission to events, alter the program or seating arrangements for events, or even postpone or cancel events in certain circumstances. Movies@ Montecasino cannot accept any liability should any of the aforementioned occur. You can, however, contact our onsite ticket counter to enquire about any relevant refund or exchange procedures that may apply in these instances.

3.3 Movies@ Montecasino does not determine or control ticket prices or seating availability. There may be many agents selling the Tickets referring to the same seating inventory. Tickets for popular events may therefore sell out quickly.

3.4 Movies@ Montecasino may, in its discretion, limit your purchase of tickets to a specified number of tickets for any event (the “ticket limit”) to discourage unfair ticket buying practices. In such event movies@ Montecasino will not be obliged to supply you any tickets in excess of the relevant ticket limit
